I am aware that during the ski tour, mountain trip, course or anyother program or activity that I am participating in under the arrangement of Independent Mountain Guides certain risk and dangers exist including, but not limited to, travel by air, automobile, or other conveyance, travel in mountainous terrain, the forces of nature, accident, injury, illness, paralysis, or death in remote places, with rapid means of evacuation to medical facilities.
In consideration of, and as part payment, for the right to participate in such course, mountain trip or activity and services and food arranged for me by IMG Ltd, its instructors, guides, agents and associates, I do here by assume all of the above risks and will hold them harmless from any responsibility, negligence, actions or suits of any kind or nature whatsoever for loss or damage to property or personal injuries sustained or occurring during any course, guided trip or activity of any nature.
THIS SHALL SERVE AS A RELEASE AND ASSUMPTION OF RISK FOR MYSELF, MY HEIRS, ADMINISTRATORS, EXECUTORS, AND FOR ALL MEMBERS OF MY FAMILY INCLUDING MINORS WHO MAYBE ACCOMPANYING ME.
I agree that if I make any claims or sue Independent Mountain Guides Ltd and its contracted staff in violation of this waver, I shall be liable to IMG Ltd and its contracted staff for all costs, solicitors fees incurred by IMG Ltd and its contracted staff in defending themselves from such claim or action.
If you cancel any course or trip (for day trips; the day before the trip FULL REFUND LESS THE DEPOSIT, NO REFUND IF YOU CANCEL ON THE DAY OF THE TRIP OR COURSE; if you cancel for multi-day trips or courses before one week prior to the commencement of the trip or course a FULL REFUND WILL BE GIVEN LESS THE DEPOSIT; in the event of cancellation of less than one week before the commencement of the multi-day trip or course ONLY 50% REFUND WILL BE GIVEN INCLUDING THE DEPOSIT).
You may wish to transfer your trip / course date in lieu of cancellation which will be accepted with no charge or penalty.
In the event of unavailability of aircraft, bad weather, closures, or guide/instructor judgement calls, trips / courses may be relocated to other area and venues to enable the completion of the trip / course. NO REFUNDS WILL BE GIVEN FOR SUCH RELOCATION OR TEMPORARY POSTPONEMENT.
It is suggested that all course / trip participants hld adequate all risks insurance coverage before enrolling on an IMG Ltd course / trip.
If IMG must cancel a course / trip due to untenable factors you will receive a full refund. IMG is not accountable for airline, bus, train or other means of travel or additional expense should they cancel at any time. There are insurance progams available for your protection.
